Code of conduct

EL-O-MATIC GmbH has a long and good tradition maintaining compliance with the highest ethical standards. EL-O-MATIC GmbH intends to maintain these standards in all kind of business relationships. They apply when taking over business, as well as when fulfilling contractual obligations. Improper activities can not only damage the reputation of EL-O-MATIC GmbH, but can also have negative consequences towards employees and business partners. Even the appearance of bad behavior could cause harm. The Code of Ethics for Business Partners ("Code") outlines the expectations of EL-O-MATIC GmbH with regard to ethical and business standards. We expect our business partners to adhere to this code.

General ethical standards

Below you will find the general standards that all business partners shall meet. These standards are not necessarily the only obligations that apply to the behavior of business partners. In general, all business partners should take care to avoid behavior that could reasonably appear improper or that could damage the reputation or integrity of EL-O-MATIC GmbH.

1. Compliance with rules, laws and regulations

Business partners should operate in full compliance with the laws of their respective countries and with all other applicable laws, rules and regulations. This does include, but is not limited to applicable U.S. export control laws and regulations, as well as applicable laws of other countries.

2. Conflict of interests

Every employee of a business partner who is deemed to have a personal, business or financial interest, not in accordance with the loyalty and responsibility of EL-O-MATIC GmbH shall be reported to EL-O-MATIC GmbH.

3. Equal opportunities, harassment and sexual harassment

Business partners should offer a job free from harassment and discrimination. Discrimination based on race, color, religion, gender, sexual orientation, age, disability, national origin or any other factor considered illegal by the applicable laws and regulations is not acceptable.

4. Political payments

Business partners should not use funds or assets to support candidates in political office or to support political parties or committees in general, unless permitted by law, or only if approval can be obtained in advance from the competent authorities.

5. Confidential information

Business partners shall take reasonable measures to protect any data received from EL-O-MATIC GmbH in line with existing agreements and laws concerning the use and / or disclosure of the data.

6. Use of personal data

Business partner should treat personal data of EL-O-MATCI employees in accordance with applicable data protection laws and other applicable laws, regulations or rules.

7. Antitrust / Competition law

Business partners should comply with antitrust and competition laws and should not have an agreement or plan, expressed or implied, formal or informal, in writing or orally with a competitor regarding prices, terms of sale or delivery, production, distribution, territories or customers with a business partner or exchange or discuss competitors. If a business partner identifies this behavior internally, which could pose a problem in antitrust or competition law, they should notify EL-O-MATIC GmbH immediately.

8. Accounting systems, books and records / public disclosure and financial reporting

Business partners should comply with the requirements of the respective countries and all other applicable laws and regulations for bookkeeping, disclosure and reporting

9. Business integrity

Any corruption, extortion and / or embezzlement is prohibited. Business partners should not pay or accept bribes or participate in any other illegal business or government incentive and should act at all times in accordance with all applicable corruption laws such as the Foreign Corrupt Practices Act or the British Bribery Act.

10. Boycott

Many countries prohibit companies from participating in economic boycotts against other countries. Detailed and complex regulations have been enacted that prohibit the implementation and support of boycott measures. These regulations prohibit EL-O-MATIC GmbH or one of its employees from participating in the design of a boycott based on race, religion, gender or national origin. The regulations also require that certain requests to participate in a boycott be reported to the government and authorities immediately.

11. Health, safety and environment

Business partners should commit to comply with all federal, state and local laws and regulations applicable to their business, including those affecting health, safety and the environment, around the world.

Application to sub-contractors

This code also applies to any subcontractor of a business partner who provides goods or services. The business partner is responsible for ensuring compliance with this Code for such a subcontractor as if he / she were the business partner himself.

Consequences of non-compliance

If EL-O-MATIC GmbH is informed about any actions or conditions that are not in accordance with this code, EL-O-MATIC GmbH reserves the right to request corrective measures. EL-O-MATIC GmbH also reserves the right to terminate an existing agreement with any business partner that does not comply with this code.
